Introduction

The Information Technology Practice Group is composed of experienced lawyers from the independent affiliated law firms that comprise Canadian Litigation Counsel. These lawyers and their firms are available to work independently or, where instructed, in collaboration with one another in the rapidly developing area of e-commerce and information technology risks. These risks involve both first and third party exposures.

First party risks include interruption of service, destruction of data, software and hardware, unauthorized system access and theft of proprietary and confidential information.

Third party risks include defamation, invasion of privacy, sexual harassment, professional liability, directors and officers liability, trademark and copyright infringement, and breach of contract.

The Information Technology specialists provide three main areas of legal service:

Legal Risk Management and Loss Prevention Advice

The individual lawyers of the Information Technology Group are available to provide advice on legal risk management and loss prevention issues including new developments in case law and legislation as they pertain the areas of e-commerce and information technology risks, to participate in seminars and to make presentations in these subject areas.

Coverage

A primary concern of the Insurer and Insured is to what extent, if any, e-commerce and information technology risks fall within the scope of insurance coverage. Since the independent affiliated law firms of Canadian Litigation Counsel specialize in providing insurance related services, the lawyers specializing in Information Technology have expertise in coverage issues and are qualified to provide:

  • legal analysis of all of the relevant primary, excess and umbrella policies in force with a view to determining the coverage available
  • analysis of coverage provisions prior to issuance of the policy
  • ongoing advice directed to upgrading existing policy wordings

Defence/Recovery

A critical element of concern is to insure that the potential for Defence/ Recovery is given utmost priority from first notification of a loss. This includes:

  • early evaluation of the loss
  • analysis of coverage provisions prior to issuance of the policy
  • the development and preservation of relevant evidence
